Application of the Agreement

The terms and conditions for Junky Travels LLP. (TRAVEL JUNKY) to provide services to the person or people ("the User") wishing to purchase or enquiring about any of TRAVEL JUNKY's goods and/or services are included in this agreement ("user agreement"). TRAVEL JUNKY may also be reached through any of its other customer interface channels. In the agreement, User and TRAVEL JUNKY are referred to as parties, both individually and collectively.

The User's Duty of Consciousness

When a User uses TRAVEL JUNKY's services, it is assumed that they have read, comprehended, and explicitly agreed to the terms and conditions of this agreement. These terms and conditions will apply to any desired transaction or service provision by TRAVEL JUNKY and will be binding on the User. Regarding any services to be rendered by TRAVEL JUNKY, all rights and obligations of the User and/or TRAVEL JUNKY shall be limited to the terms and conditions of this agreement.

TRAVEL JUNKY retains the right, at any time and without prior notice, to terminate access to any or all of its websites, other sales channels, and related services, or any portion thereof, for general maintenance or any other reason.

There are additional terms of service (TOS) that are unique to the goods and services offered by TRAVEL JUNKY, such as vacation packages and airline tickets, in addition to this agreement. Travel Junky will supply and update such TOS, which will be considered a part of this Agreement. Should there be a discrepancy between such TOS and this Agreement, the terms of this Agreement will take precedence. The applicable TOS for the service or product that the user is using must be read and accepted by the user. Furthermore, the terms and conditions that apply to specific features, promotions, or the operational guidelines and policies that are relevant to each Service (such as travel, lodging, packages, etc.) May be provided by the Service Provider itself.

The User is in charge of making sure that the terms and conditions, including those outlined in a service provider's fare rules, contract of carriage, or other rules, are followed by the service provider with whom the User chooses to do business.

The User is granted access to TRAVEL JUNKY's Services subject to acceptance of all terms, conditions, and notices included in this Agreement and the TOS, as may be updated from time to time, without modification. To dispel confusion, it is made clear that using the Services signifies the User's acknowledgment and acceptance of the TOS and this Agreement.

The User shall not use TRAVEL JUNKY's Services if the User disagrees in any way with any of these terms, conditions, or notices.

These terms will take precedence over any additional terms or rules found in any other TRAVEL JUNKY document in the event that any of the terms, conditions, and notices contained herein conflict with them.

Details of Third-Party Accounts

Through the use of the Account Access feature on TRAVEL JUNKY's websites, the User grants permission to TRAVEL JUNKY and its representatives to retrieve requested information from third-party websites, such as banks and other payment gateways, that they have designated or that they represent.

Travel Junky disclaims all liability for any loss that the user may suffer as a result of someone else using his account or password without authorization, whether that happens with or without his knowledge. The User will never use another person's password.

Keep Information Private

Any information that TRAVEL JUNKY expressly designates as confidential must be kept private by the user and will not be shared unless necessary to comply with legal requirements, fulfill the terms of this agreement, or fulfill the obligations of both parties thereunder.

Usage of Mobile Apps and Websites

TRAVEL JUNKY disclaims all liability for your use of any information or materials on the website and mobile app, which you do at your own risk. You will be responsible for making sure that any goods, services, or data accessed via our website or app adhere to your specific requirements.

It is prohibited for you to change, copy, distribute, transmit, reproduce, publish, license, or sell any data, software, goods, or services that you obtain from this website or application. It is prohibited to duplicate content from the website and app, as stated in the copyright notice that is a part of the Terms of Use.

Furthermore, TRAVEL JUNKY maintains the exclusive right to alter, amend, and remove any of the contents without notifying anyone in advance.

Use of the User's Mobile Number Through TRAVEL JUNKY

Booking confirmation, itinerary details, cancellation, payment confirmation, refund status, schedule changes, and any other pertinent information about the transaction may be sent by TRAVEL JUNKY via SMS or voice call to the phone number the user provided when making the reservation. If the user is unable to complete the booking for any reason, TRAVEL JUNKY may also get in touch with them via voice call, SMS, or email to find out how they would like to proceed and to offer assistance.

By sending an SMS, email, or voice call to TRAVEL JUNKY, the user hereby unconditionally consents that such communications are (a) made at their request and authorization; (b) considered "transactional" and not "unsolicited commercial communication" in accordance with the guidelines of the Telecom Regulation Authority of India (TRAI); and (c) in accordance with the applicable guidelines of TRAI or such other authority in India and abroad.

The User shall hold Travel Junky harmless from any and all losses and damages suffered by Travel Junky as a result of any action taken by TRAI or any other authority in relation to any incorrect complaint that the User raises on Travel Junky regarding the aforementioned notifications, or in the event that the User provides a false phone number or email address for any reason.

Responsibility of the User

Only the transactions made by the User via TRAVEL JUNKY are under TRAVEL JUNKY's control. Transactions, including their legality and validity under the User's home country's laws, are not subject to screening, censorship, or other controls by TRAVEL JUNKY.

The user must cross-verify the data and bookings for accuracy. In connection with the use of the services, the user guarantees that they will comply by all such additional protocols and guidelines, as amended from time to time. Additionally, the User guarantees that for each transaction, they will abide by all applicable laws and regulations regarding the use of the services in the relevant jurisdiction.

Protection / Insurance

It is the responsibility and choice of the user to obtain adequate insurance coverage, unless otherwise specified by TRAVEL JUNKY in any particular service or deliverable. TRAVEL JUNKY does not accept any claims resulting from such situations.

If travel junky offers insurance as a component of its services or products, it will be provided subject to the terms and conditions set forth by the insurance provider. For any claims or disputes, the User must get in touch with the insurance company directly. TRAVEL JUNKY will not give any explicit or implicit guarantees that the insurance company will accept the claims.

Force Majeure Situations

The user acknowledges that there may be exceptional situations in which the service providers—airlines, hotels, individual transportation providers, or other businesses—are unable to fulfill confirmed reservations for a variety of reasons, including weather, labor disputes, bankruptcy, business needs, political decisions, operational and technical difficulties, flight and route cancellations, etc. When TRAVEL JUNKY receives advance notice of circumstances that may lead to booking dishonor, it will try its hardest to offer its clients an equivalent alternative or, if approved and reimbursed by the relevant service providers, reimburse the full booking amount after reasonable service charges.

The user acknowledges that TRAVEL JUNKY, acting as an agent to facilitate the booking services, shall not be liable for any such situations and that any further resolutions or refunds must be obtained directly from the service provider.

The User acknowledges that services rendered previously may not be provided or may require significant modification in the event of any technical or other malfunction on the part of TRAVEL JUNKY. In these situations, TRAVEL JUNKY will fully release itself from any and all liabilities arising from the non-provision of services or defects by returning the full amount paid by the customer for using the services, less any applicable cancellation, refund, or other fees. Any additional obligations will be assumed by the user.

Travel Junky disclaims all liability for any delays, inability to perform, or nonperformance of all or part of its obligations resulting from causes beyond its reasonable control and not attributable to its actions or inactions, such as acts of God, fire, strikes, embargo, government actions, acts of terrorism, or other similar causes, issues at the airline, rail, bus, hotel, or transporter's end. As soon as circumstances allow, the impacted user will be promptly notified in such an event.

Notwithstanding the foregoing, TRAVEL JUNKY's maximum liability relating to any services provided on the website under any circumstances will be restricted to returning the full amount paid by the client for using the services, less any applicable cancellation, refund, or other fees. Under no circumstances will the liability extend to any loss, damage, or extra cost in excess of what Travel Junky has charged for its services.

If there is a problem with the use or performance of the TRAVEL JUNKY website(s) or any other channel, TRAVEL JUNKY and/or its suppliers will not be responsible for any direct, indirect, punitive, incidental, special, consequential, or any other damages, including but not limited to damages for loss of use, data, or profits. In addition, TRAVEL JUNKY disclaims all liability for any damages resulting from using the TRAVEL JUNKY website(s), including but not limited to contract, tort, negligence, strict liability, and other legal theories. These damages may also include delays in using the TRAVEL JUNKY websites or related services, the provision of services or failure to provide services, and any information, software, products, services, and related graphics obtained through the TRAVEL JUNKY website(s).

Any mistakes, omissions, or representations on any of its pages, links, or linked website pages are not under the control of TRAVEL JUNKY.

Security of Downloaded Data

By using the Service, the User acknowledges and accepts that any material and/or data downloaded or otherwise obtained is done so at their own risk and discretion. The User also agrees that they will be solely responsible for any loss of data or damage to their computer systems that may arise from the download of such material and/or data.

However, TRAVEL JUNKY will always try its hardest to guarantee that there are no viruses or other malicious programs on the content of its websites or other information channels.

Responses From Clients And Requests

The User would like to learn more about TRAVEL JUNKY's services, which include hotel reservations, car rentals, and vacation packages, in order to improve their travel experience. By signing this agreement, the User expressly permits TRAVEL JUNKY to periodically send offers to the User via direct mail, email, phone calls, short messaging services (SMS), or any other medium. If the customer would prefer not to be contacted, he or she may notify the relevant service provider of their preferences or write to TRAVEL JUNKY at info@traveljunky.co.in for specific exclusion.

Customers are encouraged to read and comprehend TRAVEL JUNKY's privacy policy, which outlines how the company contacts, requests, and shares user information.

Exclusive Rights

The User may receive content from TRAVEL JUNKY in the form of audio, images, graphics, videos, or other materials from sponsor advertisements or information. Trademarks, copyrights, and other laws pertaining to intellectual property may protect this content.

The User may not copy, transmit, or create derivative works of this material without express permission from Travel Junky.The User may only use this material as specifically permitted by Travel Junky.

The User understands and agrees that, absent the owner's express written consent, he or she will not upload, post, reproduce, or distribute any content on or through the Services that is protected by a third party's copyright or other proprietary rights.

The proper copyright or other proprietary rights notice must be included with any copyrighted or other proprietary content that is shared with the owner's permission. Unauthorized submission or distribution of proprietary or copyrighted content is prohibited and can result in criminal charges or personal liability for the user.

User's Obligations Regarding Visas

The applicable visa requirements, which each traveler must obtain, apply to the travel arrangements made by TRAVEL JUNKY. Travel Junky disclaims all liability for any problems resulting from these visa requirements, including the inability to travel, and for any reason whatsoever, including the inability to receive a refund for any unused reservations.

Compensation

If TRAVEL JUNKY and/or its affiliates, partner websites and their respective lawful successors and assigns are sued, the User agrees to indemnify, defend, and hold harmless TRAVEL JUNKY and/or its affiliates, their websites, and their respective lawful successors and assigns from and against all losses, liabilities, claims, damages, costs and expenses (including reasonable legal fees and disbursements in connection therewith and interest chargeable thereon) that are made against or incurred by TRAVEL JUNKY and/or its affiliates, partner websites and their respective lawful successors and assigns. These parties will also agree to reimburse TRAVEL JUNKY and/or its affiliates for any losses, liabilities, claims, damages, and expenses.

Any violation of national laws or a general code of conduct will be the sole and exclusive responsibility of the user, and TRAVEL JUNKY will not be held accountable.

The Right to Decline

At its sole discretion, TRAVEL JUNKY retains the right to refuse any customer order without providing a reason. When the customer pays the full amount due for the service and TRAVEL JUNKY accepts it, the contract to provide any service is not finalized.

Travel Junky may restrict the user's activity, remove the user's listing, alert other users to the user's actions, immediately suspend or terminate the user's registration temporarily or indefinitely, and/or refuse to grant the user access to the website, without affecting TRAVEL JUNKY's other remedies under this agreement, the TOS, or applicable law:

• The user violates the terms of service, this agreement, and/or the documents it references.

• Travel Junky is unable to confirm or authenticate any information the user provides.

• Travel Junky thinks the user's actions could violate any applicable laws, infringe on the rights of third parties, or otherwise put the user, other website users, and/or Travel Junky in jeopardy.

Travel Junky retains the right, at any time and without notice, to restore suspended users. After being placed on indefinite suspension, the user is not allowed to use the website in any way or attempt to register with TRAVEL JUNKY again until TRAVEL JUNKY reinstates them.

Despite the foregoing, TRAVEL JUNKY retains the right to pursue strict legal action as it deems necessary in order to recover any money that the user owes to TRAVEL JUNKY and/or the service provider in the event that the user violates this agreement, the TOS, or the documents it incorporates by reference.

The ability to withdraw When User Information Is Inaccurate

When requesting any services under this agreement, the User specifically agrees to provide TRAVEL JUNKY only accurate and legitimate information and to not misrepresent any facts at all. Should the User fail to abide by this agreement, TRAVEL JUNKY will no longer be able to provide services to them.

TRAVEL JUNKY shall have the unrestricted right to take any action against the User(s), including cancellation of the bookings, etc., without giving the User any prior notice if it discovers, or has reason to believe, at any point during or after receiving a request for services from the User, that the request is either unauthorized or that the information provided by the User or any of them is incorrect or that any fact has been misrepresented by him. In such a case, TRAVEL JUNKY disclaims all liability and responsibility for any loss or harm that the User or any of them may sustain as a result of the cancellation of the reservation or services.

TRAVEL JUNKY is not liable for any loss or damage resulting from actions taken by TRAVEL JUNKY to protect its own interests and those of its legitimate customers. The User unconditionally indemnifies TRAVEL JUNKY from any such claim or liability. In addition, TRAVEL JUNKY would be able to refuse or cancel any reservations due to possible fraudulent transactions.

Ability to Sever

In the event that any part of this agreement is found to be invalid or unenforceable in whole or in part, the invalidity or unenforceability will only apply to that portion of the agreement; the remaining portion of the agreement, along with all other provisions, will remain fully enforceable.

Headings

The headings and subheadings contained herein are merely for the purpose of convenience and identification; they have no meaning whatsoever that would define, interpret, characterize, or restrict the scope, extent, or intent of this agreement, terms and conditions, notices, or the User's right to use this website or any other section or page of TRAVEL JUNKY Websites or its partner websites, or any provision hereof.

These terms take precedence over any additional terms or rules found on any specific TRAVEL JUNKY website in the event that any of the terms, conditions, and notices contained herein conflict with them.

Partnership

No section or page of the TRAVEL JUNKY website or the websites of its partners, including this one, nor any terms and conditions, notices, or the User's right to use this website, shall be deemed to constitute a partnership between the User and TRAVEL JUNKY, and neither party shall have the authority to bind the other in any manner or be regarded as its agent.

Connection

No part of this agreement, terms and conditions, notices, or the User's right to use this website, along with any other section or page of TRAVEL JUNKY Websites or its partner websites, shall be deemed to create a partnership between the User and TRAVEL JUNKY. Neither party shall have the authority to bind the other in any manner or be regarded as its agent. Updates To The Information Provided By TRAVEL JUNKY The user states that TRAVEL JUNKY takes reasonable care and diligence when providing services. It makes every effort to guarantee that the user experiences no inconvenience.

Changes To These Terms Of Service

The terms, conditions, and notices under which the TRAVEL JUNKY websites are provided, including but not limited to the fees, are subject to change at any time without prior notice. It shall be the User's responsibility to periodically review these terms and conditions.

Authority

By this express disclaimer, TRAVEL JUNKY explicitly waives any implied warranties imposed by the laws of any jurisdiction or nation other than those in which its offices are located. Travel Junky regards itself as subject to the exclusive jurisdiction of the courts located in Delhi, India.

Using Customers' Vacation Photos

Any image or video uploaded by clients in emails or support groups before, during, or after their trip will be utilized on social media platforms to interact with users.
